Republicans campaigned on jobs in 2010 -- but instead of creating a single job they've wasted 280 days passing legislation to make sure no government money goes to abortion when there's already been a law on the books for 35 years that does that. They've wasted 280 days trying to overturn Roe vs. Wade so they can put the government in charge of a woman's uterus -- all the while talking about how they want to keep big government out of our private lives. They've wasted 280 days bashing gays, talking about Sharia law, laying off teachers & firemen & police, trying to destroy Social Security and Medicare, praying to Jesus, and doing everything except the one thing that needs to be done -- create jobs.

They've done everything possible to prevent job creation for 280 days. 280 days of obstruction and saying no to every single thing that would move America forward. 280 wasted days! ATTENTION ALL TRAITOROUS RIGHT WING FUCKS: if you seriously think the American people believe that restricting abortion or privatizing the post office will create jobs you're out of your fucking minds. You've completely underestimated us - you've attacked us long enough and you've pushed us too far. The pot is boiling over and now we're coming for YOU! You've fucked with a sleeping giant who's going to wake up and crush you - we're coming for you, and we're going to exterminate you like the stinking little insects you are.

Washington Post : George F. Will : "Romney, supposedly the Republican most electable next November, is a recidivist reviser of his principles who is not only becoming less electable; he might damage GOP chances of capturing the Senate"

.
Harsh Critique of Mitt Romney by one of the most prestigious Conservative Pundits, Intellectuals and Writers. George F. Will is a highly respected Republican.

This in addition to another Conservative Critic of Mitt Romney : Rush Limbaugh finds many faults in Mitt Romney and considers RomneyCare as a bad baggage of this candidate, a horrible Weakness for a Republican Candidate. A big liability, a handicap, hindrance or disadvantage that is going to harm the Republican Party in the General Election of November 2012.

Mitt Romney, the pretzel candidate

Some excerpts :

Republican successes down the ticket will depend on the energies of the Tea Party and other conservatives, who will be deflated by a nominee whose blurry profile in caution communicates only calculated trimming.

Republicans may have found their Michael Dukakis, a technocratic Massachusetts governor who takes his bearings from “data” (although there is precious little to support Romney’s idea that in-state college tuition for children of illegal immigrants is a powerful magnet for such immigrants) and who believes elections should be about (in Dukakis’s words) “competence,” not “ideology.” But what would President Romney competently do when not pondering ethanol subsidies that he forthrightly says should stop sometime before “forever”? Has conservatism come so far, surmounting so many obstacles, to settle, at a moment of economic crisis, for this?

New Free Trade Agreements - FTA's are not pacts with the Devil and Even Goethe's Dr Faust didn't go to Hell and was saved

.
I am on the side of the optimists and those that want to increase trade everywhere.

If any nation is harmed because of Big Imports and Low Exports in the course of applying an FTA, then things can be renegotiated, discussed, conversed and even repealed, cancelled, revoked, rescinded. But I know that things usually won't come to such extremes.

There is a spirit of Friendship, Political Alliance and even a Cultural Effort in these FTA's.

Forget the Western Hemisphere, I think that my words are true anywhere.

FTA's are not pacts with the Devil and Even Goethe's Dr Faust didn't go to Hell and was saved.

How do you think the bizarre Mormon Doctrine would fare in the eye of the public in the general election? Not so well. In fact, it would seem to be the plan to allow the RNC to nominate Romney so that his Mormonism can be used to totally discredit him in the general election

Mitt Romney, Mormonism and bad politics

Some excerpts :

(1) If Romney suddenly became a Mormon who took his faith seriously, he would be subject to the Mormon prophet. LDS theology teaches that the prophet living in Salt Lake City, Utah is the literal mouthpiece of God. Understand this, please! To disobey what God has said through the prophet is a very heinous sin. If the prophet was given a revelation from God that President Romney must do something…he better do it! This is not conjecture or speculation…this is reality. If Romney took his LDS faith seriously, the Mormon mouthpiece for God would have unprecedented control over US affairs. I am not being sensational, this is just where a Romney presidency would lead.

(2) There is that pesky “White Horse Prophecy” in which Mormons believe that the United States Constitution would be hanging by a thread and a Mormon would come to the rescue and fundamentally transform America. I was wary of George Bush’s questionable theology and his sense of divine calling. I am greatly concerned over Mitt Romney’s potential feeling of divine appointment.

(3) Those supporting Rick Perry have come out calling Mormonism a cult (See Denny Burk’s post). For that claim they have endured quite a bit of heat. However, it is Mormonism that from the beginning has called orthodox Christianity a false religion. Romney has asked Perry to repudiate the claims the Mormonism is a cult. I think Perry should…on one condition. Romney state that Joseph Smith was wrong when he claimed that God told him all the denominations that compose protestant Christianity were corrupt. The problem is…Romney cannot do that or he would no longer be a Mormon. Perry can say Mormonism is not a cult but a false world religion and remain true to his own convictions.

(4) Romney, as a Mormon, is a tri-theist at best (three gods) and polytheist at worst (believes there are many gods – Mormon Doctrine, 163). Romney must also believe that God was once a man like us who became a god (Joseph Smith, Times and Seasons, vol. 5, p. 613-614). Further, Romney must believe that by being a good Mormon he can eventually become a god of his own planet (Teachings of the Prophet Joseph Smith, p. 345-347). There are other bizarre beliefs in the LDS faith but this gives you the picture. How do you think material like this would fare in the eye of the public in the general election? Not so well. In fact, it would seem to be the plan to allow the RNC to nominate Romney so that his Mormonism can be used to totally discredit him in the general election.

All this to say, Mitt Romney is a dangerous candidate to nominate. I hope and pray that he is not the alternative to President Obama. If he is, well…pick your poison.

Republican Party : My contribution to the GOP on how to ripen Marco Rubio for Vice President : As with a hard avocado : wrap it in newspapers, use the gas that a bunch of bananas or apples release - The Avocado will be soon mature

.
And apply a little of Sarah Palin's Magic Pepper :

Wrap Marco Rubio in Newspapers or in Fox News if that is possible. I think that the wrapping in Newspapers has already begun because of the Encomiastic Laudatory Eulogies that I read in the Republican Press. That is High praise and commendation of the Latino Trojan Horse to attract Latinos to the voting booth, in the same way that flies are captured in a sticking paper impregnated with honey.

If you are a fan of Avocados like me, then you will find that the Newspapers work wonders ripening the Avocado, and a bunch of bananas or apples accelerates the process of maturation.

The GOP has grave problems of being accessible to Minorities. There are Latino "renegades" working for this tribe, but I think that their efforts will bear poor fruits.

America is an Exceptional Nation and has Great Exceptionalism : Where else can an unknown guy skyrocket to fame and even to the Presidency after being perfectly unknown.

The bets are open in all casinos and gamblers, bettors and bookies are attentive to see if this Cuban American Guy ( Marco Rubio ) is launched to Political Stardom.

Like Sarah Palin - Sigh ... Sigh .... Sigh ....

SB 1070 : Slavery was Constitutional, Legal, Lawful and Enforced and it caused a Civil War - Segregation was also Constitu. Legal and Lawful - Same for Apartheid - Nuremberg Laws against Jews were constitutional, Legal, Lawful - Hitler reached power by Elections

.
The "Rule of Law" : Is it an inescapable decree of God ??

The appointment of Hitler as Chancellor of the German Reich was legal, lawful and constitutional. On January 30, 1933, President Hindenburg appointed Adolf Hitler chancellor of Germany.

I continue : the U. S. Supreme Court enforced Slavery, Segregation, etc .... All these notes are to prove that Constitutional, Lawful, Legal, Law, etc .... does not have the same meaning as Human, Humane, Humanistic, Charitable, Historically Sound or Progressive, etc ...

Great Teachers like Henry David Thoreau, Mahatma Gandhi, Martin Luther King, etc ... have taught that laws can be disobeyed when they are unjust, inhuman, etc ..

General Erich Ludendorff 1865-1937- to Marshall Paul von Hindenburg 1847-1934 :

"By appointing Hitler Chancellor of the Reich, you have handed over our sacred German Fatherland to one of the greatest demagogues of all time. I prophesy to you this evil man will plunge our Reich into the abyss and will inflict immeasurable woe on our nation. Future generations will curse you in your grave for this action".

To Paul von Hindenburg after he appointed Hitler as Chancellor of the Reich. Quoted in "The Holocaust: A Primary Source History" - by Judy Bartel - History - 2005

About Arizona and SB 1070 :

This State Law can be found Constitutional, Legal and Lawful by the U. S. Supreme Court. But I find myself with some historical ideas buzzing inside my head like bees :

If the Supreme Court rubber stamps SB 1070 then any of 50 States can produce any law about Immigration.

Soon there will be 50 different laws.

During the early Middle Ages every Feud, County, Municipality, etc ... had its own laws according to the whims of the Feudal Barons. Later when Kings ( or Parliaments ) became powerful in the different nations these laws were unified.

Even in the times of Napoleon Bonaparte laws were unified for France.

So, if laws are going to be fragmented and broken for any State of the USA, we are witnessing a process that is anti-Historic and counterproductive. This is Organized Chaos.

So the U. S. Supreme Court can be the cause of a Big Political Turmoil and Juridical Chaos with a Decision against the U. S. Government and in favor of Arizona.

Not to mention the Economic Losses that will ensue in some States.

All religions are crazy, Some just hide their craziness better than others - Greta Christina visits Mormon Buildings and "attractions" in Salt Lake City, Utah, designed to entice - Shock, Horror, Repulsion, Hilarity, Laughter !

.
Why we see and feel less horror, craziness, battiness, insanity in Catholicism and Protestantism than in Mormonism :

Atheist Greta Christina goes to Mormon Temple Square, tabernacle, assembly hall : "What a nightmare of indoctrination and brainwashing it was". - "It inspired me to work on my atheist activism ten times harder than I ever had"

Mormons believe that Jesus visited America after the crucifixion for the purpose of taking his message to the descendants of ancient Israelite tribes who had lived there for centuries, forgotten by history and unknown to modern archaeology. Nothing has been confirmed by Science or History. Mormonism was also tainted with Racism against Blacks.

Are All Religions Equally Crazy?

Some excerpts :

There is some profoundly crazy stuff in Mormonism. The magic underwear. The retroactive baptism of the dead. Getting to be a god on your own planet after you die. The Garden of Eden being in Missouri. The foundational story of Joseph Smith reading secret magical golden plates through a magic hat. The baptismal font sitting on the backs of 12 cows. (Okay, fine, oxen. Still.) The washings and anointings and veils and temple garments and secret handshakes and other highly ritualized pseudo-Masonic ceremonies. Lying for the Lord. (No, really. Look it up.) The casual shrugging-off of well-known, thoroughly documented facts of history and archaeology that contradict Church doctrine. The shameless, barefaced retroactive continuity, to the point of actually lying about the religion's history. ("Polygamy is not a central tenet of Mormonism, and it never was. Racial bigotry is not a central tenet of Mormonism, and it never was. Stop looking at the Book of Mormon. No, stop it. We'll tell you what our religion says, thank you very much.") Mormonism loves to present a wholesome, clean-cut image of almost obsessive normality to the public... but when you scratch the surface, what you see is howling, chaotic lunacy. That assessment may seem harsh -- but if these ideas were presented in any context other than a religious one, nobody would be debating it.
...............

The fascinating thing about Mormonism is that we can see this process happening in real time. As a religion founded within the last two centuries, during a time of good historical record-keeping, Mormonism is an intriguing case study of how a religion transforms from a despised fringe cult to a popular branch of mainstream modern faith. And part of that picture is the ways that the fringier elements have either been abandoned wholesale or kept out of the public eye. .. and indeed kept out of the eyes of its own adherents until they've already bought in. (Mormonism even has a "milk before meat" concept: teach the easy, non-controversial stuff about Mormonism first, and wait to teach the batty stuff until adherents are too deeply invested to leave.) The degree to which Mormonism has become mainstream is the degree to which the less digestible nuts have been eliminated from the fruitcake.

Importance of Racism for the 2012 Presidential Election : Applying Newton's Third Law to the Republican Party - "If object A exerts a force F on object B, then object B exerts an equal and opposite force -F on object A"

.
The GOP believes that it is going to buy Minority voters on the cheap. That if they sing siren songs to attract people then many Latinos, Blacks, Asians, Native American Indians, Biracials and Triracials will flock to the GOP like flies to Honey, that they will rush to the tents of Prosperity and Streets Paved with Gold that the Republican Party offers for Minorities, the Poor and the Disadvantaged, or the Underdogs at Large.

That there will be a New California Gold Rush in 2012, but not to Liberal California ( a state that will never be a den of bigotry ) but to the always living ideas and ideals of the Confederacy.

Add if you like Unmarried Women, and Educated Women, that can always be associated to the underdogs. And they are great targets of domination for the Republicans.

Add also Gays/Lesbians/Transgender and many others that can also be members of the Underdogs Club of Despised and Persecuted Human Beings.

Obama is a Brave and Bold Man. He went into Enemy Territory in a bus trip and survived to tell the story after being greeted with "Confederate Flags" ( one of the flags was Jumbo Size ).

I always love brave and bold people - "Goddess Fortune gives her favors to the Audacious" said Hernan Cortes, conqueror of Mexico, with a few Spaniards and in the midst of opposition to Cortes and even warfare from other Spaniards against Cortes, a fearless man of superb boldness.

I salute President Obama that went to Virginia and North Carolina and visited the most Republican Counties and Towns, without fear of being heckled and yelled. This is like Mitch McConnell and John Boehner campaigning in Harlem, New York City.

Let's return to Physics and to Sir Isaac Newton :

Super Conservative Republican Pollster Jay Cost : Harry Reid and Lyndon Baines Johnson teach how to win a tough election - The problem Jay is that Today's Republicans are Real Actual Genuine in Existence Factual Monsters

.
The Problem dear Jay Cost is that Sharron Angle and Barry Goldwater were real monsters and not imaginary ogres, they were real inhuman and wicked freaks. Sharron and Barry G. were not bogeymen to frighten Children. And a big part of the electorate knew that all too well.

Just as the Republican Party today, highly influenced by the Tea Party. The GOP has become the Party of NO NO NO, of Obstruction, Gridlock, Destruction of America with False Economic Solutions that have been tried for many years and that led to this big Recession.

And the Republican Party represented by its leadership and Candidates has also become the Party of Bigotry, Racism, Fanaticism, Irrationality, Racial Hatred, Hate against Minorities and the Poor. That is the GOP today is the Party of Unreason and Religious Bigotry.

Jay Cost does not mention it, but the "decisive minority of this group that found Angle to be unacceptable" were the Latinos.

Morning Jay: What Harry Reid Can Teach the GOP About 2012

Some excerpts :

"The fact Reid won another term in the 2010 midterm election despite Congress's widespread unpopularity, of which he was the leader, should serve as a lesson and warning for Republicans as the primary season begins".

The secret to Reid's success lies in these two sets of numbers from the 2010 Nevada exit poll.

............

Charts follow

.............

The implication of these charts is troubling. A solid majority of Nevada voters disapproved of both President Obama and Senator Reid, yet the latter was able to win a secure victory. The reason? A decisive minority of this group found Angle to be unacceptable. She only won 78 percent of the Obama disapprovers and a terrible 82 percent of the Reid disapprovers.

What is clear from the exit poll data as well as the campaign itself was that Reid perfectly executed the “frontlash” strategy. He attacked Angle with vigor and, thanks in no small part to the Republican’s own missteps, was able to tag her as extreme. A staggering 45 percent of voters thought Angle’s positions were “too conservative,” and Reid captured 75 percent of those voters.

This “frontlash” strategy has deep roots in the American political tradition. The Lyndon Johnson campaign actually coined the term in 1964; fearful of an electoral backlash to the Civil Rights Act, Johnson set about creating a frontlash by tagging Goldwater as a dangerous extremist. The “Daisy Ad” is the most infamous example, but this ad is actually a better illustration of frontlash in action.

Obama woos disheartened Latino voters

Some excerpts :

Meeting with Latino journalists last month in the White House, Obama was on the defensive, objecting to the idea that he should go further on his own, without Congress. "The notion that somehow, by myself, I can go and do these things - it's just not true," he said.

The answer left some deflated.

"When he stands up in front of a Latino audience and says, 'Don't expect me to be powerful,' OK; no wonder people are saying, 'Why should we get excited about the dude?' " said Frank Sharry, founder of America's Voice, a pro-immigration group.

The president has been inviting Latino activists, entertainers and journalists to private, off-the-record meetings at which he touts his record: Latinas appointed to his Cabinet and the Supreme Court, a Medal of Honor to an Army Ranger who is Latino. Recently, the Interior Department hosted a forum on Latino heritage to find ways to tell "the story of the American Latino."
..............

In Albuquerque one recent weeknight, volunteers had more humble ambitions. Fortified by spicy bowls of pozole, they called Latino voters in an effort to build a groundswell behind Obama's jobs package. Segueing quickly from the jobs plan to a campaign pitch, they also invited people to come in and volunteer.

Winning over voters was hard. Many of those whom Canales and the other volunteers call have been influenced by Republican criticism of Obama, she said. But Canales was determined. When she called .............

Leaderless, consensus-based participatory democracy and its discontents

Some excerpts :

Unlike a tea-party protest. OWS is not simply a group of like-minded people gathered together to make a point with a show of collective force, though it is that.

The difference is that it has developed into an ongoing micro-society with a micro-government that directly exemplifies a principled alternative to the prevailing American order. The complaint that OWS has failed to produce a coherent list of demands seems to me to miss much of the point of the encampment in Zuccotti Park. The demand is a society more like the little one OWS protestors have mocked up in the park. The mode of governance is the message.

And what is the message of the "General Assembly", the governing body of the original financial-district occupation? According its website:

New York City General Assemblies are an open, participatory and horizontally organized process through which we are building the capacity to constitute ourselves in public as autonomous collective forces within and against the constant crises of our times.

Got that? If this sounds a bit academic, that's because it is. Whether you're having trouble parsing this or not, this piece by Dan Berrett on the academic roots of OWS's governing ideology is incredibly helpful.

Mr Berrett focuses on the influence of David Graeber, "an ethnographer, anarchist, and reader in anthropology at the University of London's Goldsmiths campus." Mr Graeber was impressed by the people of Betafo, in Madagascar, who ruled themselves through a process of "consensus decision-making" demonstrating the left-anarchist ideal of "democracy without government". Mr Graeber applied what he learned in his ethnographic work in some of the left-wing anti-globalisation protests of the 1990s, and has now brought his experience to bear on Wall Street, laying the groundwork for OWS's experiment in participatory democracy. As Mr Berrett reports:

Soon after the magazine Adbusters published an appeal to set up a "peaceful barricade" on Wall Street, Mr. Graeber spent six weeks in New York helping to plan the demonstrations before an initial march by protesters on September 17, which culminated in the occupation.

Spontaneous order can take a bit of planning. But it seems Mr Graeber's planning has born fruit:

US Supreme Court denies Kansas immigrant's appeal

Some excerpts :

WICHITA, Kan. (AP) — An illegal immigrant sentenced to more than a decade in prison for repeatedly returning to the United States following deportation exhausted his appeals this week when the U.S. Supreme Court refused to hear a Kansas case that now sets the standard in 10th Circuit federal district courts for what jurors must consider in deliberating criminal immigration verdicts.

Eusebio Sierra-Ledesma, a 73-year-old Mexican immigrant, was sentenced last year to a total of 127 months in prison for repeated illegal re-entry so flagrant that U.S. District Judge Monti Belot told him that he needed to "impress upon you the seriousness of your crime."

Sierra-Ledesma had been in immigration custody 19 times and had used more than 40 aliases, 10 false dates of birth and seven false Social Security numbers. His criminal record dating to 1964 included illicit drug sales, weapons crimes and immigration offenses.
...........

Sierra-Ledesma's defense attorney did not respond to an email seeking comment. But Sierra-Ledesma told The Associated Press last year in a jailhouse phone call that he keeps returning to the United States to look for work and to see his family.

He legally entered the country as a farm worker in 1958 and built a life here before losing his legal residency in 1973, he said. He has 10 grown children from two marriages, along with 46 grandchildren and 38 great-grandchildren — all living in the United States.

"I have to come see them — everyone is here," Sierra-Ledesma said in Spanish.

Sometime he climbs the border fence to get into the United States, sometimes he walks for days across the desert, he said.

Sierra-Ledesma told the AP he does not know whether he will again return this time after he is released from prison and deported again.

"Perhaps I may not come," he said. "It is very hard being in prison."

I've always thought that people in countries like Canada and the UK were pretty happy with their healthcare systems, and even though it does have a few flaws, overall socialized medicine is still better than what we have here. And just recently they rated the UK's National Health Service as the best healthcare in the world so I was pretty convinced. And just recently when they rated the UK's National Health Service as the best healthcare in the world, I was pretty convinced. But I was wrong. I don't think there's any doubt about it -- socialized medicine is so bad it's a miracle anybody survives! I hope the Republicans win the 2012 elections and get rid of Medicare before any more senior citizens get hurt... or God forbid -- sentenced by a death panel! We have to protect our struggling health insurance companies because they're some of the few US companies still in business creating jobs! And even though you might have to and live in your car and eat cardboard to afford an operation here, at least you'd be able to say you live in America - the country that has the best damn healthcare system in the world!

Long-life Texas GOP Latino Leader Leaves Republican Party After Herman Cain Advocates the Death of Immigrants

The Declaration of "Somos Republicans" Texas State Director Lauro Antonio Garza

Today, we find the Republican Party has strayed from its roots and its founding principals so far that they can no longer be seen. We saw this yesterday, in the glare of broad daylight, when a leading presidential candidate, Herman Cain, not once, but twice, advocated for the murder of innocent people and that was met with cheers!Somos Republicans, America’s largest organization of conservative Hispanics, was alone in its criticism of this loud mouth hateful bigot. He says he was “joking.” Nobody here is laughing! The fact the GOP allows and applauds such outrageous thoughts is beyond reprehensible.

To us, the idea of allegedly “Pro-Life” people shouting for the un-Constitutional use of deadly force is unbelievable. Then, too, we shouldn’t be surprised since Republican leaders have been advocating for the nullification of the American Constitution in states like Arizona, Georgia and now Alabama. When did Republicans, once synonymous with “conservative,” become so liberal as to attack their very own Bill of Rights in the 4th and 14th Amendments?!

Where is Republican leadership? Where has the guiding principal of “Morality” gone?! If the Republican Party cannot or will not rebuke this hateful bigot and others like him who wear the mantle of “Republican” then perhaps the time has come for a rebuke of the Party itself!

Ronald Reagan left the Democrat Party saying they had left him. Perhaps, I shall do the same because the Republican Party has become radical and unreasonable. President Reagan must be tumbling in his grave!

American Prospect : "The best outcome would be for the Supreme Court to reject the unserious arguments against the constitutionality of the Affordable Care Act and uphold the legislation"

"But if the Court is going to reject the bill, it is probably better for democracy that it be done during a time of maximum political visibility, rather than by dodging the issue initially and then striking it down with the campaign safely over".

Will the Supreme Court rule on the Affordable Care Act during the height of the 2012 election campaign?

Will the Supreme Court rule on the Affordable Care Act during the height of the 2012 election campaign?

Some excerpts :

This is not to deny that, as the Atlantic’s Andrew Cohen speculates, “Justice Anthony Kennedy or Chief Justice John Roberts [may] see in the jurisdictional issues a way out, a compromise, that would both dispose of the pending cases and help protect the Court from the inevitable political criticism it will receive no matter how it rules on the merits.” Such an outcome is certainly possible, particularly because a ruling issued this term would probably come down right in the middle of what is likely to be the most polarized election campaign since 1964. A majority of the Court could decide that, indeed, discretion is the better part of valor. But it is only likely to do so if at least one of its Republican appointees is dubious about the constitutional challenge on its merits. If a majority of justices are convinced that the ACA violates the Constitution, they won’t have any problem taking jurisdiction of the case.

Liberals who see a jurisdictional dodge as a potentially attractive escape may also want to be careful what they wish for. Any reprieve would be temporary. Once the law fully goes into effect in 2014, standing requirements will not provide much of a barrier, at least for cases like the one brought by Liberty University, even to skeptical judges. If Obama is re-elected, the chances of getting a favorable ruling can’t be worse and may be better; if Mitt Romney or Rick Perry gets to select a replacement for the ailing Ruth Bader Ginsburg, on the other hand, the chances that the Affordable Care Act would survive a Supreme Court review drop precipitously.

Ultimately, the best outcome would be for the Supreme Court to reject the unserious arguments against the constitutionality of the Affordable Care Act and uphold the legislation. But if the Court is going to reject the bill, it is probably better for democracy that it be done during a time of maximum political visibility, rather than by dodging the issue initially and then striking it down with the campaign safely over. Should the Court dodge the issue to avoid a strong public response and then strike the bill down later, this would be the worst of all worlds. The public should be aware that, among other things, presidential elections are contests between competing constitutional visions.

Constitutional challenges to the Patient Protection and Affordable Care Act ( ACA ) - ACA Litigation Blog - The Supreme Court is overburdened with very explosive cases - Speculation on dates for ACA, SB 1070 and other high voltage cases

.
Everything is very uncertain. Certioraris not yet granted :

This is very speculative : important disputes are presently on track to be heard in late March or mid-April, the Court is waiting for several responses and papers before granting Certioraris. But nobody can guarantee that cases are going to be heard fast and soon. There is a possibility that the Supreme Court denies review in Arizona v United States ( SB 1070 ) or in Fisher v. University of Texas.

November 10, and some other moving pieces

November 10, and some other moving pieces

This is the date that the United States's response is due in Liberty University v. Geithner, the latest response date for any of the pending six petitions for certiorari. It is also the date that the United State's response is now due in Arizona v. United States (thanks to a recently granted extension), the case in which the federal government has sued (successfully to this point) to block the four most controversial provisions of Arizona's controversial S.B. 1070. To oversimplify a bit, Arizona's law requires that, in several circumstances, police officers must take steps to enforce federal immigration law and to investigate whether certain individuals are legally present in the United States.

I mention this only because, in landmark cases such as this, timing can matter. If the Court were to wait to receive all the responses in the ACA cases before making a cert decision, then it is on schedule to consider the petition in Arizona v. United States at the very same conference. As Lyle Denniston detailed yesterday, this would be the conference of December 9. And if the Court were to grant in both cases at that conference, it would be releasing a rather monumental order list that afternoon (or perhaps Monday morning, December 12).

More importantly, the two disputes are presently on track to be heard in late March or mid-April. And it is probably worth asking whether the Court might be chary to issue two huge decisions, within days of each other, on such highly-charged, highly-partisan issues, in a manner that risks creating the perception that the Court is acting "politically"--particularly if both cases are decided according to an ideologically predictable 5-4 split. Moreover, this concern might grow even more acute if the Court grants in Fisher v. University of Texas, the case challenging the University's use of race in undergraduate admissions (which is also on track, if certiorari is granted, to be heard this spring).

Who knows how much these considerations might affect the justices, either consciously or unconsciously? Moreover, who knows exactly what practical steps they might take, even if these considerations do matter? One response would be to defer or deny review in Arizona or Fisher. But if all three cases end up at the Court this spring--a distinct possibility at this point--there seems a decent chance that exactly how the Court resolves Arizona and Fisher will affect its approach to the ACA.

US Supreme Court rules against Arizona violent vigilante rancher in assault of undocumented people - Cochise resident rancher must pay illegal entrants $87,000 - SC upheld a ruling by the 9th U.S. Circuit Court of Appeals in February ( located in San Francisco )

This shows how difficult is to predict what the Supreme Court is going to do in these cases that are related to Immigration. This is a Great Rejection of Vigilantism by the U. S. Supreme Court.

US Supreme Court turns away rancher Barnett in assault case

Some excerpts :

The U.S. Supreme Court has upheld a 2009 ruling against Cochise County rancher Roger Barnett, forcing him to pay about $87,000 in damages related to his assault of illegal immigrants on his ranch in 2004.

The decision comes after the same ruling by the 9th U.S. Circuit Court of Appeals in February.

The court disagreed with the arguments made in the appeal, which included a claim that U.S. District Judge John Roll made errors while presiding over the 2009 trial. Roll was one of six people killed in the Jan. 8 mass shooting in Tucson.

In that February 2009 trial, a federal jury issued a split verdict in the case against Barnett stemming from the 2004 incident. The jury found he didn't violate the group's civil rights and that he wasn't liable on claims of battery and false imprisonment.

But the jury found him liable on four claims of assault and four claims of infliction of emotional distress, and ordered Barnett to pay $77,804 in damages. The $87,000 he must pay reflects that original amount plus interest.

The 2004 incident occurred near Douglas when Barnett approached a group of 16 illegal immigrants while he was carrying a gun and accompanied by a large dog. Attorneys for the plaintiffs - five women and 11 men who had crossed into the U.S. illegally - say Barnett held the group captive at gunpoint, threatening that his dog would attack and that he would shoot anyone who tried to escape.

Some of them may have great academic qualifications and even some savings. So they go to protest, perhaps as a way to be entertained, to get some new friends, to discuss politics real time with human beings at close distance.

People that go to a protest to get new ideas, friends, or a date, that is OK and "Constitutional and Lawful"....

I have great sympathy for people working in a trading floor, they should not be disturbed, but a protest in a park or a sidewalk where they do not hinder or destroy the work of others. That is OK to me.

I only condemn blocking the Brooklyn Bridge, or some stupid act like that. But the protest is human, natural, rational, noble, kind and even necessary.

In the "Grapes of Wrath" of John Steinbeck, you can read about people that underwent Great Sufferings, not because they were lazy or hated work, but because of Fate and Destiny.

While small business suffered terribly during the Great Depression, big corporations did well. When large companies needed to lay off workers to maintain profitability, they did so ruthlessly :

.
Bursts of economic growth, however, were rarely accompanied by an increase in employment. Why? Because new technology allowed companies to increase productivity at the expense of workers. Just like today.

The 1930s Sure Sound Familiar

Some excerpts :

Not long ago, someone suggested that I read “Since Yesterday,” a book by Frederick Lewis Allen, a popular historian of the 1930s and 1940s. Published in 1940, it turned out to be a shrewd, concise, wonderfully written account of America in the ’30s.

It also turned out to be something else: a reminder of why history matters. It is impossible to read “Since Yesterday” without reflecting, again and again, on the parallels between then and now. The Great Depression, of course, dominates the book — and is far worse than anything we’ve been through. Still, when Allen writes about Ivar Kreuger, the industrialist who built an empire that some considered a Ponzi scheme, you instantly think of Bernie Madoff. The country’s fixation with the Lindbergh kidnapping seems strikingly similar to the country’s fixation with Casey Anthony.

And when Allen describes “Hooverville” — a large encampment of war veterans demanding promised bonus payments — Occupy Wall Street springs to mind. The veterans, who had gathered in a park near the Capitol, were treated well at first, but were eventually routed by the Army in a brutal show of force.

In “Since Yesterday,” bankers are vilified; homes are foreclosed on; people desperately search for work — just like today. Businessmen speak of the need for “confidence,” a word that “enters the vocabulary only when confidence is lacking.” Elsewhere Allen writes, “No longer were vital economic decisions made at international conferences of bankers; now they were made only by the political leaders of states.”

U. S. Supreme Court : More delays for USA. v. Arizona, the SB 1070 "papers please" case - SC granted two more writs of certiorari October 11th, SB 1070 not on this list and neither was the writ denied - Supreme Court is delaying or postponing the hot potato of AZ Anti-Immigration Law

.
And the Court issued 12½ pages of cert denials in their order. The Court granted two more writs of certiorari October 11th. U.S.A. The Circuit Courts are not in agreement in these two cases. The Supreme Court is lately considering cases where Circuits are split and States are split.

The Supreme Court does not want to be burned with the SB 1070 hot potato. This Political Ticking Bomb can be delayed, so that the Circuit Courts of Appeals generate more jurisprudence and more wisdom on Immigration.

I want to emphasize that the opinion of the Circuits do not create a judicial obligation for the Supreme Court, but otherwise, the opinion of Great Scholars and Studious Sages in the Circuits can not be easily dismissed or thrown out to the Garbage Can. In a certain sense the circuits create a moral and political obligation, a bias or slant for a decision high above in the Supreme Court.

It is an excellent idea not to rush to give decisions on this dangerous case of "Papers Please", this is a political ticking bomb, and even great scholars and sages can make mistakes that will be very costly in the future and generate bad fame and ill disposition in the public for the U. S. Supreme Court. It is a good idea to be prudent and cautious.

GOP's Favorite Solution: Doing Nothing

Some excerpts :

WASHINGTON -- So let’s see: The solution to large-scale abuses of the financial system, a breakdown of the private sector, extreme economic inequality and the failure of companies and individuals to invest and create jobs is -- well, to give even more money and power to very wealthy people, to disable government and to trust those who got us into the mess to get us out of it.

That’s a brief summary of the news from the Republican Party this week. It’s what Republican candidates said during the Washington Post-Bloomberg debate, and it’s the signal Senate Republicans sent in voting as a bloc against President Obama’s jobs bill. Don’t just do something, stand there.

Those who have plenty of capital to invest are holding back because consumers don’t have enough cash. But let's not give potential middle-class buyers jobs and money to spend. No, let's heap yet more resources onto investors. And if sharp guys made fortunes writing abusive mortgages, let’s repeal all the rules we just passed to prevent them from doing the same thing again.

Better yet, don’t blame the people who got the windfalls. Blame poor people. Thus did Rep. Michele Bachmann place responsibility for the mortgage mess on the Community Reinvestment Act, a law aimed at preventing discrimination against people in neighborhoods, many of them predominantly African-American, where banks wouldn’t make loans. The CRA had nothing to do with the proliferation of subprime mortgages; old-fashioned greed did the trick there. But it’s so much easier to pass the buck to the powerless. They don’t make many campaign contributions.

Then there is Herman Cain’s 9-9-9 tax plan, the only policy proposal to get really serious attention at Tuesday’s encounter. The biggest flaw in Cain’s scheme barely got discussed. It is designed to shift the tax burden away from the wealthy and toward the middle class and the poor by cutting income, corporate, capital gains and estate taxes. It would then collect a lot of new money from a 9 percent federal sales tax, layered on top of existing sales taxes. Plutocracy, thy name is 9-9-9.

A letter to Birmingham: From the anti-Mexican State of Arizona

Some excerpts :

Here, we have heard your governor, Robert Bentley, brag about the toughness of HB 56. Truthfully, there’s a bit of racial nostalgia and wistfulness communicated in his voice, projecting the sublime and whispered wish: “If we could only also apply these laws to our Black population too.” Am I mistaken, or is he not the same governor who in January proclaimed that only people who believe in Jesus Christ are his brothers and sisters.

As such, I don’t have to wonder what he thinks of Muslims, Buddhists, Hindus and Jews. But forgive me if this causes me to question whether he considers African Americans, American Indians, Arab Americans and Mexicans as his true brothers and sisters too. As long as they are “legal”?

Birmingham, is this how you wish to be known and remembered? As a place that in the 21st century openly and legally dehumanizes its brown populations?

Birmingham, do you think the world actually believes you when you say you have nothing against brown people, Mexicans or immigrants – that your only beef is with “illegal aliens?” Do you think your ability to discern is credible? Isn’t that like dehumanizing African Americans, but hiding behind “states rights.” Wasn’t slavery and segregation legal in your state, in this country?

So Birmingham, yes, please lecture us on “the rule of law.” And keep listening to your governor, because we here in Arizona are certainly paying close attention. Here are his words in reaction to the judge’s ruling: “…this fight is just beginning… I will continue to fight at every turn to defend this law against any and all challenges.”

Birmi george-wallace

Don’t know what you hear, but eerily, we hear echoes of George Wallace: “segregation now, segregation tomorrow, segregation forever!”

Birmingham, your state legislature and your governor have once again brought “disgrace upon your state.” We know the objective is to take HB 56 to the Supreme Court. And let’s not mince words; we know that ethnic cleansing is not an unintended consequence. Yet it doesn’t have to be that way. Here, we thank your civil and human rights organizations and your religious community. Please continue to fight. Our memory is long. Yes, we remember the 1950s and 1960s… but we also remember the Trail of Tears. Please do not permit a new one on your soil. After all, the brown men, women and children subject to this new draconian measure… they are our brothers and sisters… as they are yours.

If you're a Teabagger, put on your powdered wig and tri-cornered hat for a little history lesson. The original Boston Tea Party, the one from the history books, was sparked by a corporate tax cut for a British corporation. It was civil disobedience against a private corporation. The original Boston Tea Party feared that corporate greed would destroy America. The original Boston Tea Party believed government was necessary to protect us against corporate excess. How many teabaggers did you see getting arrested at their protests? None. We all saw their signs that are THIS CLOSE to being threats against the president of the United States, but did you see anyone getting beat up, maced, or arrested? No! When we saw teabaggers bringing loaded guns to town halls and speeches by Obama, did you see any of them getting hauled off in handcuffs? No! You know how to tell who the good guys are? The sane people? The people who represent the truth? They're the ones the police are beating up, macing and arresting.

That's exactly how it was in the 60's when me and my hippy friends were protesting the Viet Nam war. If you haven't heard of Kent State, go look it up. 4 dead in Ohio! And do you know who came out on the right side of history. We did. We were right back then when everybody said we were wrong -- and everybody knows it now. The Wall Street protestors are the real deal - they're on the right side of history. They know who the real enemy is, and if you live long enough, you'll see I'm right.

Mormon Polygamy, Racism and Massacres of White People : Brigham Young (1801-1877) said "If the white man who belongs to the chosen seed mixes his blood with the seed of Cain, the penalty, under the law of God, is death on the spot. This will always be so"

.
I have already written about the Big Scoundrel, Liar and Prophet Joseph Smith (1805-1844), the story of a Deceiver, something like a Quack Doctor or Snake Oil Salesman dedicated to lies, falsities and deception, add the abuse of Women. Let's study the life of his main successor Brigham Young.

Brigham Young in Wikipedia

Some excerpts of a very long article :

Brigham Young is generally credited with having been responsible for revoking the priesthood and temple blessings from black members of the LDS Church, who had been treated equally in this respect under Joseph Smith's presidency.

During the Mormon flight from Illinois towards Utah in 1847, Brigham Young received a letter informing him of an inter-racial marriage by the son of a prominent black member, Walker Lewis. The letter was written by William Ivers Appleby, a Mormon elder, who desired to know if interracial marriage was an acceptable practice. Appleby sent the letter to Young at Winter Quarters, Nebraska, but Young was actually in Utah, and therefore did not receive Appleby's missive until December 1, 1847, when he returned to Winter Quarters. Quite coincidentally, Appleby himself arrived in Winter Quarters on December 2. Young read Appleby's letter and then had him personally report to Young and the eight apostles who were then in Nebraska.[17] In 1863, Young reported that he said, "Shall I tell you the law of God in regard to the African race? If the white man who belongs to the chosen seed mixes his blood with the seed of Cain, the penalty, under the law of God, is death on the spot. This will always be so" (Journal of Discourses, vol. 10, p. 110).[18]

After settling in Utah in 1848, Brigham Young announced a priesthood ban which prohibited all men of black African descent from holding the priesthood.[16] In connection, Mormons of African descent could not participate in Mormon temple rites such as the Endowment or sealing. These racial restrictions remained in place until 1978, when the policy was rescinded by President of the Church Spencer W. Kimball.

Mountain Meadows massacre

A controversial issue is the extent of Young's involvement in the Mountain Meadows massacre,[21] which took place in Washington County in 1857. Leonard J. Arrington reports that Brigham Young received a rider at his office on the same day. When he learned what was contemplated by the members of the LDS Church in Parowan and Cedar City, he sent back a letter that the Fancher party be allowed to pass through the territory unmolested.[22] Young's letter supposedly arrived two days too late, on September 13, 1857. As governor, Young had promised the federal government he would protect immigrants passing through Utah Territory. But he had also allegedly told local Native American leaders that they had his permission to steal cattle from these wagon trains.

Over 120 men, women and children were killed by the Mormons and their Native American allies. It is clear that local Mormons were the principal perpetrators. United States Army officer James Henry Carleton was sent to investigate the massacre and was convinced that the Mormons were the perpetrators. Only children survived, the murdered members of the wagon train (known as the Fancher Party) were left unburied, and the surviving children were cared for by local Mormon families. The remains of about forty people were found and buried and Carleton had a large cross made from local trees, the transverse beam bearing the engraving, "Vengeance Is Mine, Saith The Lord: I Will Repay" and erected a cairn of rocks at the site. A large slab of granite was put up on which he had the following words engraved: "HERE 120 MEN, WOMEN AND CHILDREN WERE MASSACRED IN COLD BLOOD EARLY IN SEPTEMBER, 1857. THEY WERE FROM ARKANSAS." For two years the monument stood as a warning to those travelling the Spanish Trail through Mountain Meadow. Some claim that, In 1861, Young brought an entourage to Mountain Meadows and had the cairn and cross destroyed, while exclaiming, "Vengeance is mine and I have taken a little".

These Children don't know the customs, history, language of any other country, except America where they are hated by a bunch of Racists and Tea Party Cretins. What can these Children do with their lives ??

Suddenly a bunch of White Supremacists want to kick you out from your home and from your family, because some of your relatives may be in hiding. They have to hide somewhere.

Yes, Evil never ends. Some people want to promulgate laws like those of Nuremberg. When Adolf Hitler and Herman Goering dispossessed Jews of their German Citizenship, and forbade the possession of typewriters and pets for the Jews.

Who are the Monsters ??? - Who are the Bastards ??

And finally, the Nuremberg Racist Laws were very popular. Don't tell me that SB 1070 is very popular. The Rule of Law ?? - Don't make me laugh !

But this will generate a terrible political turmoil inside and outside the USA.

The United States has anti-bodies in the blood against these un-American and anti-American Events. Sooner or Later the tide will ebb.

HuffPost : The Federal Government filed a challenge against Alabama's Harsh Immigration Law to the 11th Circuit Court of Appeals in Atlanta. New Law checks the immigration status of students in public schools and exposes school children to great difficulties and threats of Deportation

.
It would be intelligent for the U. S. Supreme Court to wait some time until more Jurisprudence is generated about Immigration in the circuits of Appeals. This before granting Certiorari to consider SB 1070 by the Justices. At this date Certiorari has not been granted, that is requesting all the SB 1070 papers from the Ninth District Court in San Francisco.

SB 1070 is a Hot Potato or Ticking Bomb ready to generate a lot of Political Damage and Partisanship in an electoral year. Let's see if the U. S. Supreme Court returns the consideration to the ninth circuit court of appeals "en banc", that is considered by a panel of 11 circuit judges. This of course will generate more Jurisprudence, that is more constitutional scholarship and wisdom on Immigration Law.

From Wikipedia :

Headquartered in San Francisco, California, the Ninth Circuit is by far the largest of the thirteen courts of appeals, with 29 active judgeships. The court's regular meeting places are Seattle at the William K. Nakamura Courthouse, Portland at the Pioneer Courthouse, San Francisco at the James R. Browning U.S. Court of Appeals Building, and Pasadena at the Richard H. Chambers U.S. Court of Appeals, but panels of the court occasionally travel to hear cases in other locations within its territorial jurisdiction. Although the judges travel around the circuit, the court arranges its hearings so that cases from the northern region of the circuit are heard in Seattle or Portland, cases from southern California are heard in Pasadena, and cases from northern California, Nevada, Arizona, and Hawaii are heard in San Francisco. For lawyers who must come and present their cases to the court in person, this administrative grouping of cases helps to reduce the time and cost of travel

Alabama Immigration Law: Justice Department Asks Federal Appeals Court To Block Enforcement Of Measure

Some excerpts :

ATLANTA — The federal government asked an appeals court on Friday to halt an Alabama immigration law considered by many as the toughest in the United States, saying it invites discrimination against foreign-born citizens and legal immigrants.

The federal government filed the challenge to the 11th Circuit Court of Appeals in Atlanta. It claimed Alabama's new law "is highly likely to expose persons lawfully in the United States, including school children, to new difficulties in routine dealings."

The overhaul allows authorities to question people suspected of being in the country illegally and hold them without bond. It also lets officials check the immigration status of students in public schools.

A federal judge in Alabama upheld those two key aspects of the law, which have already taken effect.
